Welcome. This tool is designed to support emotional reflection, self-awareness, and mindfulness. It is not therapy and is not a substitute for professional mental health care.

These Terms of Use ("Terms") and the Privacy Policy below (collectively, this "Agreement") govern your access to and use of the Compassion Companion™ and Dream Companion™ AI‑powered wellness tools (together, the "Services") offered by Compassion Companion  (“Company”, "we," "us," or "our"). By clicking "Continue," creating an account, or otherwise using the Services, you AGREE TO BE LEGALLY BOUND by this Agreement. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.


2. IMPORTANT NOTICES — NOT MEDICAL OR MENTAL‑HEALTH ADVICE

THE SERVICES DO NOT PROVIDE MEDICAL OR MENTAL‑HEALTH ADVICE. They are operated by artificial‑intelligence software NOT BY A LICENSED HEALTH‑CARE PROVIDER. No doctor–patient, therapist–patient, or other professional relationship is created. IN AN EMERGENCY, CALL 911 (U.S.), DIAL 988, OR SEEK IMMEDIATE PROFESSIONAL HELP.


3. ELIGIBILITY AND CHILDREN’S PRIVACY

You must (a) be at least 18 years old (or the age of majority where you reside, if higher); (b) have legal capacity to contract; and (c) not be barred from using the Services under U.S. export‑control or sanctions laws. 

Our services are intended for users age 18 and older. We do not knowingly collect personal data from children under 18. If we become aware that we have inadvertently received personal information from someone under 18, we will promptly delete it.


4. LICENSE & INTELLECTUAL‑PROPERTY RIGHTS


Subject to these Terms, we grant you a limited, revocable, non‑exclusive, non‑transferable license to access and use the Services for personal, non‑commercial purposes. All content, software, and marks are owned by Company or its licensors and protected by U.S. and international IP laws.


5. ACCEPTABLE USE


You MAY NOT:

  1. upload protected health information (PHI), highly sensitive personal data, or content you lack authority to share;
  2. submit unlawful, defamatory,  harassing, or infringing material;
  3. reverse‑engineer, probe,  interfere with, or attempt to access the Services' source code or security;
  4. use automated scripts, scraping tools, or bots;
  5. misrepresent your age or otherwise circumvent the age gate;
  6. violate any applicable law or regulation.


6. AI LIMITATIONS & USER VERIFICATION

AI outputs are probabilistic and may be inaccurate, incomplete, or inappropriate. YOU MUST INDEPENDENTLY VERIFY any information before reliance. Feedback you provide may be used by us on a royalty‑free, worldwide, irrevocable basis to improve the Services.


7. MARKETING REPRESENTATIONS

You acknowledge that (a) marketing materials are for informational purposes only, (b) no representation or warranty is made that the Services will achieve any specific wellness outcome, and (c) you will not rely on promotional statements inconsistent with § 2.


8. ACCESSIBILITY COMMITMENT

9. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND—EXPRESS, IMPLIED, OR STATUTORY—including WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON‑INFRINGEMENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR‑FREE.


10. LIMITATION OF LIABILITY (WITH GROSS‑NEGLIGENCE AND PERSONAL‑INJURY CARVE‑OUT)

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COMPANY, ITS AFFILIATES, OR THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, WHETHER INCURRED DIRECTLY OR INDIRECTLY AND REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE), EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.


SUBJECT TO THE FOREGOING AND EXCEPT AS SET FORTH BELOW, THE TOTAL AGGREGATE LIABILITY OF COMPANY AND ITS AFFILIATES ARISING OUT OF OR RELATING TO THE SERVICES OR THIS AGREEMENT SHALL NOT EXCEED THE GREATER OF (A) A NOMINAL AMOUNT AND (B) THE TOTAL FEES, IF ANY, THAT YOU HAVE PAID TO COMPANY FOR ACCESS TO THE SERVICES DURING THE TWELVE (12)‑MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.


NOTHING IN THIS SECTION SHALL LIMIT OR EXCLUDE LIABILITY (I) FOR COMPANY’S OR YOUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, (II) FOR PERSONAL INJURY OR DEATH CAUSED BY NEGLIGENCE TO THE EXTENT SUCH LIMITATION IS UNLAWFUL, OR (III) WHERE SUCH LIMITATION IS OTHERWISE PROHIBITED BY APPLICABLE LAW.


11. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Company, its affiliates, and their officers, directors, employees, and agents from any third‑party claims arising from (i) your use of the Services, (ii) content you submit, or (iii) your breach of this Agreement.


12. DISPUTE RESOLUTION — BINDING ARBITRATION & CLASS‑ACTION WAIVER

Except for small claims matters, any dispute shall be resolved by confidential, binding arbitration administered by the American Arbitration Association in Vermont, under its Consumer Arbitration Rules.


YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS OR REPRESENTATIVE ACTIONS.
You may opt out within 30 days of first acceptance by emailing wildtemple@aol.com with "Arbitration Opt Out" in the subject line.


This clause is governed by the Federal Arbitration Act. Arbitration may be conducted in person, by phone, or via video conference, at the mutual agreement of the parties.

  

13. GOVERNING LAW

Vermont law governs, excluding conflict‑of‑laws principles, except that the Federal Arbitration Act governs § 12.


14. EXPORT CONTROLS

You may not use or export the Services in violation of U.S. export‑control or sanctions laws.


15. MODIFICATIONS & TERMINATION

We may modify the Services or this Agreement by posting an updated version. Continued use after the "Last Updated" date constitutes acceptance. We may suspend or terminate access for any violation or at our discretion.


16. SEVERABILITY & ENTIRE AGREEMENT

If any provision is held unenforceable, the remainder stays in force. This Agreement is the complete agreement between you and Company regarding the Services.

PART B — PRIVACY POLICY

B‑1. SCOPE

Welcome to Compassion Companion and Dream Companion (“we,” “us,” or “our”). We are committed to protecting your privacy and ensuring transparency about how your information is handled when you use our services. This Privacy Policy explains what information we collect, how we use it, and the choices you have.

This Privacy Policy explains how Company collects, uses, discloses, and safeguards information when you use the Services.

B‑2. INFORMATION WE COLLECT


Category: User Input, such as text prompts and feedback. The purpose is Deliver and improve service


Category: Payment Records, such as transaction ID, amount. Purpose is billing and fraud prevention


Category: Marketing Data (Opt-In) such as e mail address. Purpose is for newsletters and support


Category: Usage Data such as timestamps, interaction metrics, browser type. Purpose is Analytics and security



B‑3. HOW WE USE INFORMATION

  • operate and maintain the Services;
  • respond to inquiries and  feedback;
  • send transactional and, with consent,  marketing communications (opt‑out any time);
  • detect, investigate, and prevent fraud, abuse, or security incidents;
  • comply with legal obligations.


B‑4. LEGAL BASES FOR PROCESSING (GDPR/UK GDPR) 

If you are located in the European Economic Area (EEA) or the United Kingdom (UK), we process your personal data based on the following legal grounds:

· Contractual necessity – to provide you with access to Compassion Companion and fulfill our agreement with you;

· Legitimate interests – to operate, improve, and secure our services, as long as these interests are not overridden by your rights;

· Consent – when required, for example, for sending marketing communications;

· Legal obligation – when necessary to comply with applicable laws or legal requests.


B‑5. SHARING & DISCLOSURE

We share information only with service providers (OpenAI, Stripe, GoDaddy, Mailchimp) bound by confidentiality, or when legally required (e.g., lawful subpoenas).


B‑6. INTERNATIONAL TRANSFERS

Data may be processed in the United States and other jurisdictions. We rely on Standard Contractual Clauses or equivalent safeguards for cross‑border transfers.


B‑7. YOUR PRIVACY RIGHTS

Residents of California, Colorado, Virginia, other U.S. states with comprehensive privacy statutes, and the EU/UK may exercise rights to access, correct, delete, port, or restrict processing of personal data and to opt out of targeted advertising or profiling. Email wildtemple@aol.com to submit a request.


B‑8. DATA SECURITY & BREACH RESPONSE

We take reasonable administrative and technical measures to protect your personal information from unauthorized access, use, or disclosure. However, no method of transmission over the internet or electronic storage is completely secure. You use the service at your own risk. In the event of a data breach that affects personal information, we will notify affected users and any required authorities in accordance with applicable law.

We care deeply about the privacy and security of your information. We do not collect or store sensitive personal data on our own servers. When we rely on third-party providers (such as OpenAI and Stripe), we depend on their security protocols to safeguard your information. 


B‑9. RETENTION

  • Chat Data: Not stored by Company;  OpenAI retains prompts for ≤ 30 days for abuse monitoring.
  • Payment Records: Retained per Stripe policies.
  • Marketing Emails: Retained until you unsubscribe or request deletion.

B‑10. CHILDREN'S PRIVACY

The Services are NOT DIRECTED TO CHILDREN UNDER 18 (OR 16 WHERE APPLICABLE). We do not knowingly collect data from children. If we discover such data, it is deleted promptly.


B‑11. CHANGES

Material changes will be announced via email (if provided) or prominent notice on the Services at least 15 days before taking effect.
